TRADEMARK

Jordan is a member of the Paris Convention for the Protection of Industrial Property since July 17, 1972. The implementation of the International Classification of Goods and Services for the Purposes of the Registration of Marks under the Nice Agreement (Nice Classification) has been officially adopted in Jordan by November 14, 2008.

Once a trademark application is filed it is examined by the Trademark office within 45-days from filing date against prior applications and registrations. If no prior rights are available, an official filing receipt (primary Approval) will be issued and a filing number will be granted; otherwise, the Trademark Office might request modifications or clarifications.

Law No. 34 for 1999 (Amendment of Trademark Law)

-        Registration validity: 10-years.

-        Renewal Duration: 10-years.

Trademark Requirements:

-        A Power of Attorney duly Notarized and Legalized up to the Jordanian Consulate.

-        A Certified copy of the priority document (in case priority is to be claimed).

It is permitted to file trademark application(s) and obtain official filing receipt(s) with temporary filing number(s) which will be final upon acceptance and fixed filing date(s) without the legalized power of attorney which can be submitted within a grace period of 3-months calculated from filing date which also not applied strictly; however when an application is examined where the legalized power of attorney is not submitted the trademarks examiner will issue an office action requesting the legalized power of attorney and giving another grace period of 1-month to submit the same which can be extended for 3-times of a month each. Document 2 should be filed within 3-months from filing date.

Time Frame:

The expected time frame from filing a trademark application up to registration, in the normal course of action; is approximately from 12 to 14 months.

Classification:

-        The International Classification of Goods and Services (10th Edition) is followed.

-        A separate application is required for each class.

Renewal Requirements:

-        A Power of attorney duly notarized and legalized up to the Jordanian Consulate 

Please be advised that the POA should be submitted with the renewal application on the time of payment of the renewal fees.

Validity:

Trademark registrations are valid for 10 years calculated from filing date or from priority date if priority is claimed, and are renewable for like periods. There is a grace period of 1-year for late renewals without payment of a surcharge.

Conducting a trademark Search:

-        An official search may be conducted for word marks and devices.

-        It takes approximately 4 working days for the results to be available. A separate application is required for search in each class. The search report discloses similar and/or identical trademarks.

Recordal of Assignment Requirements:

-        A Power of attorney from the assignee, legalized; and deed of assignment, legalized;

-        both parties should submit a certified copy of their Company’s Commercial Register;

-        Arabic translation of all non-Arabic documents certified by the notary public locally.

Recordal of Change of Name/Address Requirements:

-        A Power of attorney, legalized; and certificate of change of name, legalized.

-        For a change of address, only a legalized power of attorney showing the new address is required.

Recordal of license agreement Requirements:

-        A Power of attorney, legalized; and license agreement, legalized.

Recordal of Merger Requirements:

-        A Power of attorney, legalized; and certificate of merger, legalized.

The Power of Attorney to be submitted for the assignment, license or pledge of trademark should be newly drafted (no more than one year old); 

Cancellation action:

-        A trademark is subject to cancellation by any interested party within 5-years from registration date.

In the same context, we wish to confirm you that it is permitted to conducting a search by proprietor name.

PATENT

Novelty and Discloser requirements:

-        In Jordan any patent application should be filed within 12 months starting from the first worldwide disclosure is available, in which the application can be filed without claiming a priority.

Formal Examination Procedure:

-        Once all formalities filed the application will be examined with respect to compliance with the formalities provided for under the patent law. 

Substantive Examination Procedure:

-        The examination fees must be pay once the formal examination completed either voluntary or in response to the relevant invitation.

-        There is no special request for examination. Yet, amending the current claims to match the European allowed claims (after the end of opposition period) usually leads to accelerate registration. In other words, the substantive examination that will be conducted by the European examiners for the European counterpart will be taken into consideration to decide whether the application can be registered or not.

-        The examinations of other countries such as US & PCT will be taken into consideration for cases in which a European counterpart has not been filed.

Validity: 

-        For national phase applications, annites are to be paid starting from the 1st year calculated based on the PCT filing date. 

-        For conventional patent applications, annuities are to be paid while the application is still pending calculated based on the national filing date. Otherwise, all overdue annuities must be paid at the time of registration.

-        The due annuities for conventional and national phase application can be paid within a grace period of six months with a penalty.

The term of patent protection:

 In Jordan the term of patent protection is 20 years as from the filing date. The application is subject to the payment of the prescribed annuity fees starting from the filing year, due at the time of registration. Further annual maintenance fees are payable on each anniversary of the filing date of the application. There is a grace period of six months for late payment of these annual maintenance fees with penalty fees.

Patent Requirements:

-        A Power of attorney duly notarized and legalized up to the Jordanian Consulate.

-        A Patent Form 4 legalized up to the Jordanian Consulate.

-        A Certified copy of the home letters patent.

-        Three copies of specifications, claims and drawings in English with Arabic translation thereof.

-        Abstract of about 200 words in English with Arabic translation thereof.

-        A Certified copy of certificate of incorporation or extract from the commercial register for the applicant(s).

-        A Certified copy of priority document in case priority is to be claimed.

DESIGN

Novelty and Discloser requirements:

-        In Jordan is absolute novelty. Yet, a grace period of 12 months starting from the first worldwide disclosure is available, in which the application can be filed without claiming a priority.

Examination:

-        Once all formalities filed the application will be examined with respect to compliance with the Formalities & Registrability provided for under the Industrial Designs and Models Law.

Validity:

A design/ model registration is valid for fifteen years starting as from the date of filing the application or from the priority date. There is no provision in the current Design Law of Jordan for compulsory working with respect to designs.

Design Requirements:

-        A Power of attorney duly notarized and legalized up to the Jordanian Consulate.

-        Three sets of specimens or representations of the design.

-        The article(s) covered by the design and the material used in producing these items.

-        A description of the design pointing out its novel aspects

-        Extract from the commercial register legalized.

-        Declaration of ownership if the designer is different from the applicant.

-        Certified copy of priority document if claimed.

Maintenance Fees:

-        According to the new design law, which became effective in May 2000, no annuities or maintenance fees are to be paid on new design applications; all registration fees are paid in full upon filing the application.

-        The design is protected for 15-years.

Recordal of assignment requirements:

-        A Power of attorney legalized by the assignee.

-        Deed of assignment legalized.

Recordal of change of name requirements:

-        A Power of attorney legalized in the new name or address.

-        Certificate of change of name/ address legalized up to Jordan Consulate.

Recordal of change of address requirements:

-        A Power of attorney legalized in the new name or address.

-        Certificate copy of change of address.

COPYRIGHT

Copyright Law No. 22 for the year 1992 (and its amendments of 1998, 1999 and 2005) governs the protection of copyright and related rights in Jordan.

Protection covers original works of literature, art and science no matter what their type, importance or purpose is. This includes works of art expressed in writing, sound, drawing, photography and motion, such as books, speeches, plays, musical compositions, films, applied art, 3-D works and computer software.

FILING REQUIREMENTS

For written material:

1.     A Power of Attorney notarized and legalized up to the Jordanian Consulate.

2.     Four copies of the work.

For other copyrightable works:

1.     A Power of Attorney notarized and legalized up to the Jordanian Consulate.

2.     Two copies of the work.

N.B:

A copyright application can be filed only, if one of the following conditions is met:

1.     The applicant is Jordanian.

2.     The work is created by a resident in Jordan and is to be published and distributed in Jordan.

3.     The subject of the work is related to Jordan.

SEARCH REQUIREMENTS

1.     A Power of Attorney notarized and legalized up to the Jordanian Consulate.

2.     Copyright Title & Full Material.

N.B:

Copyright owners from countries that are party to the Berne Convention do not require registration.
